Terms & Conditions Zamorski BY THE SEA Anna Zamorska 

We do care about the safety and comfort of our guests. We would like to assure that nothing will disturb your stay, that is why we have clear Terms & Conditions that are binding both to us and our Guests.

The terms used in these Regulations mean:
1. Terms&Conditions – these Terms&Conditions drawn up in Polish. The other language versions are for information only.
2. The Lessor – Zamorski BY THE SEA Anna Zamorska based in Sopot (81-735) at ul. Władysława Łokietka 37, entered into the Central Register and Information on Economic Activity kept by the Minister of Development and Finance under the NIP numbers 5851033634 and REGON numbers 220976564; telephone: +48 884 683 888; e-mail address: hello@zamorskibythesea.com and office@zamorskibythesea.com.
3. Agreement – an agreement between the Customer and the Lessor for the provision of hotel services in accordance with the Act of August 29, 1997 on hotel services and the services of tour leaders and tourist guides – uniform text: Journal of Laws No. 2020 item 2211.
4. Property – real estate located in Sopot, at Władysława Łokietka 37 Street, where the services specified in the Agreement are provided.
5. Rooms – specially separated, furnished rooms with bathrooms located in the Property.
6. Guest – a natural person who uses the hotel services provided in the Property.
7. Client – an entity (a natural person, legal person or other organizational unit) using the hotel services provided at the Property under the Agreement. The provisions of the Regulations relating to the Guest shall apply accordingly to a natural person using the services provided in the Property on the basis of and under the Agreement.
8. Website – a website operated by the Lessor at https://zamorskibythesea.com that allows for obtaining information and booking hotel services provided in the Property.
9. Reservation – the procedure for ordering a stay in a Room or Rooms in advance, the main features of which are given on the Website, concluded with the conclusion of the Agreement and the issuing of a Booking Confirmation by the Lessor.
10. Reservation application – an application to reserve a Room submitted by the Customer via the website https://zamorskibythesea.com, via booking portals (Noclegi.pl, Expedia, Booking.com), via e-mail at the following e-mail address: hello@zamorskibythesea.com or in person at the Property.
11. Confirmation of receipt of the reservation application – a message sent to the e-mail address indicated by the Customer with a summary of the submitted Booking application and confirming its receipt by the Lessor.
12. Reservation fee – an advance payment within the meaning of Art. 394 of the Act of 23 April 1964 Civil Code – uniform text: Journal of Laws No. 2020 item 1740.
13. Booking confirmation – a virtual document summarizing the essential terms of the Agreement and confirming its conclusion.
14. The high season – includes the following periods:
1. Easter (from Holy Thursday to the Second Day of Easter)
2. from April 29th to May 5th inclusive
3. Feast of Corpus Christi, including three consecutive days from
4. June 23rd to September 2nd inclusive
5. from December 22nd to January 3rd of the following year inclusive
15. The average season – includes the following periods:
1. from May 6 to June 22 inclusive, excluding the period of Corpus Christi and three consecutive days inclusive
2. from September 3 to October 31 inclusive
16. The low season includes periods not included in the high and medium seasons 

1. Terms&Conditions define the rules and responsibilities of the Lessor and Guests and, respectively, Customers in connection with the provision and use of hotel services in the Property, as well as the rules for the operation and use of the Website. The rules for the collection, processing and protection of personal data necessary to perform the above-mentioned activities are specified in the Privacy Policy of Zamorski BY THE SEA Anna Zamorska.
2. Terms&Conditions are an integral part of the Agreement.
3. The Agreement is concluded by making a Reservation, by paying the Reservation Fee or the entire amount for the stay, by signing a registration card or by concluding an Agreement with the Lessor in writing. By performing the above-mentioned activities, the Customer confirms that he has read and fully accepts the terms of the Regulations and undertakes to comply with them.
4. The Terms&Conditions apply to all Guests staying in the Property. The Guest’s commencement of using the services provided in the Property confirms that he has read and fully accepts the terms of the Regulations and undertakes to comply with them.
5. Terms&Conditions are available for viewing on the Website and in the generally accessible parts of the Property. The content of the Regulations may be recorded by the Customer by printing it, saving it on a carrier or downloading it from the Website at any time. 

1. Rooms are rented for hotel days.
2. The hotel day lasts from 15:00. to 11:00. the next day.
3. Failure to leave the Room until 11:00, without the Lessor’s consent, will result in the full amount of the next night being added to the bill, in accordance with the applicable price list.
4. In a situation where the Guest does not leave the room after the expiry of the stay, the Lessor reserves the right to pack the Guest’s belongings and move them to another place in the Establishment. Packaged items will be treated as items left behind.
5. Expressing consent to extend the stay or extend the night of accommodation depends on the planned check-in of the next guests. Willingness to extend the accommodation day should be reported to the Lessor no later than 10.00 on the day of the scheduled check-out.
6. In exceptional situations, the cost of extending the night will be considered individually by the Lessor’s decision.
7. After obtaining the consent of the Lessor, it is possible to check in earlier. Obtaining such consent depends on the time of check-out of previous guests and the return of the Room for re-use by the cleaning service. 5

1. Booking can be made by:
1. booking platform available on the website https://zamorskibythesea.com,
2. via booking portals (Noclegi.pl, Expedia, Booking.com),
3. via e-mail at the following e-mail address: hello @ zamorskibythesea.com
4. in person at the Property.
2. A reservation may be made by a natural person with full legal capacity.
3. In order to make a reservation, please provide:
a) Name and surname
b) Address
c) Telephone number
d) E-mail address (e-mail)
e) Date of planned arrival and number of nights
f) Number and type of rooms booked

4. By making a reservation, the customer agrees to put his personal data in the database. These data will be used in accordance with the Privacy Policy of Zamorski BY THE SEA Anna Zamorska.

5. Customers and Guests are obliged to provide only complete and correct data. Customers and Guests acknowledge and accept that it is forbidden to provide the Lessor with untrue or misleading information.

6. After submitting the Booking Application, the Lessor shall send to the e-mail address provided by the Customer a Confirmation of receipt of the booking application for the selected Room or Room containing information on the total cost of the stay and the amount of the Booking Fee, payment date and the Lessor’s bank account number.

7. The reservation fee should be paid within 3 working days to the indicated bank account number. If the payment of the Reservation Fee is not recorded within the prescribed period, the Lessor may cancel the reservation.
8. When making a Reservation via booking platform available on the website https://zamorskibythesea.com or booking portals (Noclegi.pl, Expedia, Booking.com), it is possible to pay the Reservation Fee using the Tpay payment system. In this case, the Booking Confirmation will be sent to the Customer’s e-mail address.

9. After completing the Reservation, the Lessor will send to the e-mail address provided by the Customer a confirmation of the reservation containing a summary of essential elements of the Agreement, i.e. indication of the type of Room, date and length of stay, along with the applicable price for the service, any additional costs, and terms of cancellation of the Reservation. , information on after-sales service, as well as the Lessor’s address to which the Customer may submit complaints. In the case of a Booking carried out in person, the above information will be provided to the Customer during it or in another way agreed with the Customer. The booking confirmation is also a confirmation of the conclusion of the Agreement. 

1. The Customer may resign from the Agreement only in writing or by sending a message via e-mail to the address hello@zamorskibythesea.com.

2. In the event of resignation from staying in the Rooms, the Lessor shall refund the booking fee up to the amount of:
a) when canceling the reservation up to 3 months before the agreed date of stay – refund of 100% of the payment;
b) when canceling a reservation from 3 months to 1 month before the agreed date of stay in the High Season – a refund of 50% of the payment;
c) when canceling the reservation within less than 1 month – the fee is not refunded.

3. In a random situation, the reimbursement of the reservation fee will be considered individually by the Lessor’s decision. 

1. The Lessor accepts:
a) bank transfers,
b) online payment via tPay system (on the Website),
c) cash,
d) debit and credit cards

2. The Lessor accepts the following payment cards: VISA, Mastercard, Maestro, Diners Club International, V Pay.

3. The Lessor is a VAT taxpayer who issues settlement documents in the form of fiscal receipts and invoices. A customer who wishes to receive a fiscal receipt or an invoice for the company should report this fact at the Booking and provide the appropriate tax identification number.

4. The Lessor reserves the right to charge for the entire stay during the registration activities.
5. The Lessor may refuse to check-in the Client and, accordingly, a Guest who refuses to pay for the entire stay upon check-in.

6. Additional payments resulting from the stay shall be paid by the customer no later than on the day of departure.

7. In the event of failure to settle all payments related to the stay, the Lessor is entitled to charge the Customer for all services provided to him.

8. The Lessor reserves the right to charge the Customers and, respectively, Guests, also after their check-out, if they find losses resulting from the Guest’s stay, ie breach of the smoking ban, damage to the elements of the Property’s equipment or deficiencies in the equipment of the Rooms. If the card cannot be charged (e.g. due to the lack of card details), the Lessor has the right to seek compensation for the damage by the Customer and the Guest, respectively, in any legally permissible manner chosen by them.

1. The basis for accepting a Guest is to show the Landlord a photo ID and sign a registration card.
2. Providing personal data and presenting an identity document at check-in is voluntary, however, failure to do so makes it impossible to perform the Agreement. Such a circumstance will be treated as a cancellation of the booking by the Client and, respectively, the Guest.
3. The behavior of guests should not disturb the peaceful stay of other guests. The landlord may refuse to continue providing services to a person who violates this rule. 4. The Lessor may refuse to admit a Guest who is under the influence of alcohol, drugs or aggressive substances, as well as a Guest who broke the rules of the Regulations during their previous stay.
5. In the event of a breach by the Guest of the provisions of the Regulations, the Lessor may refuse to provide further services to the Guest and request him to leave the Property. The guest is obliged to immediately comply with the Lessor’s request. In this case, the Customer is obliged to pay the fee for the entire period of the agreed stay and (if applicable) to pay compensation for the damage caused. If the above mentioned fee has been paid by the Customer in advance, it is not refundable.
6. It is forbidden to smoke tobacco products and electronic cigarettes in the Property. It is allowed to smoke tobacco products and electronic cigarettes in a designated area outside the building. In the event of a breach of the ban, the Customer and the Guest, respectively, may be charged with a fine of PLN 500 for each found breach of the ban. 7. Possession and consumption of narcotic drugs prohibited by law is strictly prohibited in the Property. If this prohibition is found to be violated, this fact will be reported to the Police, and the Guest will have to immediately leave the Property without the right to reimbursement of costs resulting from the shortening of the stay. 8. It is not allowed to store dangerous items in the Rooms, i.e. weapons, ammunition, flammable materials, illuminating materials, etc.
9. It is prohibited to conduct canvassing and door-to-door sale in the Property.
10. For sanitary, epidemiological and health reasons (allergies), no accompanying animals are allowed in the Property during their stay.
11. The guest may not transfer the room to other people without the prior check-in of a third party, even if the period for which the guest has paid the fee for the stay has not expired.
12. In each group of persons subject to registration, at least one natural person of legal age with full legal capacity is required. In the case of reservations for more than one Room, where any of the rooms has been allocated only to minors, the person responsible for any damage is the person who undertakes to bear such responsibility. 13. If the Guest resigns from staying in the Room during the night, the Customer is obliged to pay the fee for the started night, and if it has been paid earlier, it is not refundable.
14. Persons who are not checked in the Rooms may temporarily stay in the Room from 8:00 to 21:00. If unchecked persons do not leave the Room after the specified time has elapsed, the Lessor reserves the right to add the price of the additional stay to the Room’s bill according to the valid price list.
15. There is a curfew in the Property from 22:00 to 7:00 am.
16. Each time when leaving the Room, the Guest is obliged to properly secure it, so that the access of third parties is not possible. During the Guest’s absence in the Room, windows and doors must remain closed.
17. Due to fire safety, it is forbidden to use any devices or items in the Rooms that do not constitute room equipment (e.g. heater, electric cooker, candles, etc.).
18. In the event of noticing a fire, the Guest should, if possible, notify the Lessor about the threat and go to the exit.
19. Guests are not allowed to make changes to the Rooms and their equipment, except for a slight rearrangement of furniture and equipment, without affecting their functionality and safety of Guests. 

1. The Lessor provides accommodation services on a daily basis in specially separated, furnished Rooms, along with the provision of basic services accompanying the accommodation.
2. The price of the stay includes:
a) providing information related to the stay and travel
b) breakfast – Swedish buffet
c) the possibility of using a wireless computer network (Wi-Fi) connected to the Internet in the Property
d) on request – emptying of rubbish bins, replenishment of used cosmetics and toilet 
e) on request – replacement of a set of towels in the Room after the third night of stay and then every third day

f) on request – change of bed linen in the Room after the seventh night of stay and then every seventh night g) on request – providing an iron and ironing board

h) ordering washing and ironing services on behalf of and at the expense of the Guest and the Client, respectively

i) ordering a transport service on behalf of and at the expense of the Guest and, respectively, the Client
3. It is possible to leave cars on the Lessor’s property free of charge. The number of places is limited. Please arrange availability in advance.
4. In the event of reservations regarding the quality of services, the Guest is asked to notify the Lessor, which will enable us to increase the standard of the services provided.
5. The Landlord provides the following basic equipment to each of the rented Room Guests:
a) a set of bed linen, i.e .:
• pillow with pillowcase – 1 pc / person
• duvet with duvet cover – 1 pc / person
b) a set of towels:
• large towel – 1 pc / person
• standard towel – 1 item / person
• foot towel – 1 item / Room
c) cosmetics (to be used by the guest):
• body and hair wash gel – 1 item / person
• liquid soap
d) other elements of the Room equipment are listed on the Website

1. The Guest is responsible for damages caused by the behavior of people under his supervision (e.g. minors) and people who have been introduced to the Property by the Guest.
2. The Customer, jointly and severally with the Guest, is responsible for damages caused by Guests using the Lessor’s services.
3. Guests staying in the Property with children under the age of 13 should ensure constant supervision over such children, that is, first of all, ensure that the children are in the Property in the presence of a Guest with full legal capacity and under his care.
4. The Lessor has the statutory right of lien on the items brought by the Guest to the Property, to secure the Lessor’s claims due to fees, remuneration and compensation due for the services provided.
5. The rooms have a system of entrance cards to the rooms. Losing the card is associated with a one-time fee of PLN 50. 

1. The Lessor provides:
a) Property and conditions for rest,
b) security of stay and protection of personal data,
c) professional and courteous service in the field of services provided in the Property,
d) cleaning the Room, in accordance with the rules set out in the regulations, and carrying out the necessary repairs of the equipment during the Guest’s absence, and in his presence, only if he wishes to do so,
e) technically efficient service; in the event of defects that cannot be removed, the Lessor will make efforts to alleviate the inconvenience as far as possible,
f) in the event described above or in the case of repairing the damage, the Guest waives any claims and rights to compensation.
2. The guest should notify the Landlord of any possible damage to him immediately after its discovery. 

1. Items left in the Room after the Guest’s departure will be – upon receipt of the Guest’s instruction – sent back to the address indicated by the Guest at his expense.
2. It is also possible for the Guest to collect items left by him personally. Such collection is possible at the Property.
3. If there is no instruction on the part of the Guest, the Lessor shall keep the left items for one month. Food products left in the Room in closed packages or bottles will be stored for 24 hours from the moment the Guest leaves the Property. After this period, it is considered that the things were left by the Guest with the intention of abandonment and become the property of the Lessor, who may, in particular, donate them to charity. 

1. Any comments related to the stay should be reported to the Lessor (by phone or in person). They will be dealt with immediately.
2. Any complaints regarding the services provided in the Property should be submitted by Guests and, respectively, Customers in writing via e-mail to the following address: office@zamorskibythesea.com.
3. Complaints should be submitted immediately after the occurrence of the event giving rise to the complaint, in any case not later than within 3 days from the date of such event, and in any case not later than within 14 days from the day the Guest leaves the Property.
4. The Lessor examines the complaint and informs the Guest and the Customer, respectively, of how to settle it in writing via e-mail to the address indicated in the complaint, within 14 days from the date of its receipt. If the complaint cannot be processed within 14 days, the Lessor shall notify the Guest and the Customer, respectively, of the reasons for the delay and the expected date of considering the complaint.
5 In case of further litigation between Guest and, respectively, the Customer and the Lessor Lessors the court proper for the place of Lessor’s residence shall settle the dispute. 

1. The Lessor reserves the right to make any changes to Terms & Conditions.
2. The change is effective from the moment the changes to Terms & Conditions are published on the Website and displayed for Guests in the generally accessible parts of the Property.
